Acceptance and scope

These terms govern access to Tropical Seeds websites, content, forms, quote tools, Terra AI and online commerce. By using a covered service, a user agrees to them and to any additional terms presented for a specific transaction.

If a person uses the services for a company or other organization, that person represents that they are authorized to act for it. If these terms are not accepted, the services should not be used.

Agronomic and product information

Website content is general information. Variety performance depends on climate, soil, seed quality, planting method, pests, weather, management and other conditions outside Tropical Seeds’ control. Examples, trial results and typical ranges are not guarantees of establishment, yield, forage quality, pest control, nitrogen contribution or financial outcome.

Customers are responsible for confirming local registration, labels, restrictions, planting rates, inoculation, animal-use requirements and fit for the intended location. Product labels, lot documents and written order terms control where they differ from general website content. A qualified local agronomist, veterinarian or other adviser should be consulted when appropriate.

Quotes, orders and availability

A quote request is an invitation to discuss availability and terms; it is not an accepted order. An order becomes binding only when Tropical Seeds or the applicable seller sends an order confirmation or otherwise accepts it.

Products may be limited by season, inventory, territory, registration or shipping rules. Tropical Seeds may correct errors, limit quantities, reject or cancel orders, or substitute only with customer approval. Product imagery and packaging may vary from the delivered lot.

The production checkout may be operated through Shopify and may present additional store, payment, shipping, return or subscription terms. Those transaction-specific terms will form part of the agreement.

Pricing, payment, taxes and shipping

Prices and currency will be shown at checkout or in an approved quote and may change before acceptance. Customers are responsible for applicable taxes, duties, permits and charges unless the confirmed order states otherwise.

Payment will be processed through authorized payment providers. Delivery estimates are estimates unless a guaranteed date is expressly agreed. If a shipment cannot be made within the promised period, Tropical Seeds will provide the notice and options required by applicable law. Risk of loss and title will follow the confirmed order and applicable law.

Returns, seed quality and claims

Return and refund conditions shown in the applicable quote, checkout or order confirmation will govern, subject to non-waivable legal rights. Because seed is a living agricultural product, storage, handling and planting conditions after delivery affect performance.

Customers should inspect deliveries promptly, preserve lot labels, packaging and proof of purchase, and contact Tropical Seeds as soon as a shortage, damage, identity or quality concern is discovered. The applicable quote, checkout or order confirmation will state any claims window and testing procedure.

Terra AI and interactive tools

Terra AI may produce incomplete, outdated or incorrect responses. Its output is informational and should be checked against current product documents, local requirements and qualified human advice before a decision is made.

Users must not submit unlawful content, personal payment credentials, sensitive personal data or confidential information they do not have authority to disclose. Tropical Seeds may limit or suspend use to protect the service, users or company.

Acceptable use and intellectual property

Tropical Seeds owns or licenses the website, branding, product names, text, graphics, databases and other content. Use of the site does not transfer ownership. Content may be viewed and printed for legitimate personal or internal business evaluation, but may not be scraped, republished, modified, reverse engineered or used to train a competing system without permission.

• Do not impersonate another person, submit false information or use the services unlawfully.
• Do not introduce malicious code or use automated collection in a way that burdens the service.
• Do not imply Tropical Seeds endorsement or misuse company or third-party trademarks.

Third-party services and links

The website may link to or rely on third-party services such as Shopify, payment providers, HubSpot, distributors, carriers, social platforms or research publishers. Tropical Seeds is not responsible for independent third-party sites, their content or their privacy and service practices.

Disclaimers and limits

To the fullest extent permitted by law, the website and its general informational tools are provided on an “as is” and “as available” basis. Tropical Seeds disclaims warranties that cannot reasonably apply to free informational content, while preserving any express written product warranty and rights that cannot legally be excluded.

To the fullest extent permitted by law, Tropical Seeds will not be liable for indirect, incidental, special, exemplary or consequential loss arising from use of the website or reliance on general content. Any liability concerning a seed purchase will be governed by the applicable sale terms and non-waivable law. Some jurisdictions do not allow certain exclusions, so these limits may not apply in full.

Changes, governing law and contact

Tropical Seeds may update the services and these terms. The version in effect when an order is accepted will govern that transaction unless the parties agree otherwise.

These terms are governed by Florida law, without overriding mandatory consumer or other protections that apply in a customer’s location. Any dispute will be handled under the applicable confirmed order terms and governing law.
